Terms of Use for USEYALAND Visitors

Welcome to USEYALAND, a unique cultural experience space (“the Facility”) located on the 2nd floor of the building in front of the Osaka Aquarium (Kaiyukan). USEYA Co., Ltd. (“USEYA”, “we”, “us”, or “our”) operates USEYALAND and is committed to providing you with a safe and enjoyable visit.
Please read these Terms of Use carefully before entering. By accessing or using USEYALAND facility or website, you agree to be bound by these terms and all applicable laws and regulations.

1. Access and Reservation
• Access is strictly limited to individuals registered and confirmed by USEYA at the time of reservation. Unauthorized entry is prohibited and may result in legal action, including reporting to authorities.
• Reservations are subject to manual verification. Access is granted only after explicit confirmation from USEYA, regardless of payment status. Payment alone does not guarantee entry.
• Each reservation is valid only for the date, time, and guests specified and confirmed. Transferring, reselling, or sharing reservations is strictly prohibited.
2. Surveillance and Security
• The premises are monitored by video surveillance at all times for safety, security, and management purposes. Entry constitutes consent to recording.
• USEYA reserves the right to deny entry or remove any person at its sole discretion for security or safety reasons.
3. Use of Facilities
• USEYALAND is a paid rest area featuring cultural exhibits, including large-scale figures, tatami seating, and themed interiors. Please respect all property and keep the Facility clean.
• Food and beverages are permitted only in designated areas. Alcohol consumption, smoking, vaping, and use of open flames are strictly prohibited anywhere on the premises.
• Personal belongings are your responsibility. USEYA is not responsible for lost, stolen, or damaged items.
• See "Commercial Use" below for restrictions on business, product, or promotional activities.
4. Prohibited and Dangerous Activities
• Any activity that is dangerous, reckless, or poses a risk to yourself, your guests, other people in the building, or to the facility and its equipment is strictly prohibited. This includes, but is not limited to: running, climbing, tampering with exhibits or equipment, bringing hazardous materials, or engaging in any behavior that could cause harm or damage.
• Unregistered or unauthorized entry, theft, vandalism, antisocial behavior, intoxication, excessive noise, and disruptive activity are strictly prohibited.
• Any violation may result in immediate removal, financial liability for damages, permanent ban, and/or legal action.
5. Commercial Use
• The facility and its premises may not be used, directly or indirectly, for the creation, making, or promotion of products, or for any commercial purposes (including but not limited to filming advertisements, movies, promotional videos, or similar activities) without explicit prior written permission from USEYA. Unauthorized commercial use is strictly prohibited and may result in legal action.
6. Responsibility and Liability
• The reservation holder is fully responsible for the conduct and compliance of all guests. Any damage, loss, or violation caused by you or your guests will result in full financial liability, including repair, replacement, cleaning, and any business interruption losses.
• USEYA, its operators, employees, and affiliates are not liable for any accidents, injuries, illnesses, losses, or damages incurred during your visit, except as required by law.
• You agree to indemnify, defend, and hold harmless USEYA, its operators, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Facility, your violation of these terms, or the actions of your guests.
• USEYA reserves the right to charge your payment method for any damages or losses incurred during your visit. In case of damage, you will be notified of the estimated costs and payment will be due immediately.
7. Children and Supervision
• Children under 13 must be accompanied and supervised by a parent or legal guardian at all times. The guardian is solely responsible for the child's safety and conduct.
• USEYA reserves the right to refuse entry to any child not accompanied by an adult.
8. Cancellations and Refunds
• As a general rule, no cancellations or refunds are accepted after booking. However, refunds may be granted in exceptional cases as determined by USEYA, and only after contacting USEYA directly.
• If a refund is approved, it will be processed accordingly after communication with USEYA.
• USEYA reserves the right to cancel reservations due to unforeseen circumstances, in which case a full refund will be issued. USEYA is not responsible for any other costs or losses incurred by the user due to cancellation.
9. Force Majeure
• USEYA is not liable for failure to perform obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, or facility damage.
• In such cases, USEYA will notify affected parties as soon as possible. No compensation will be provided except as required by law.
10. Identification and Data
• All visitors must upload a valid passport image for identity verification. By booking, you consent to the secure retention and use of your data for legal and operational purposes for the necessary duration only.
• USEYA will handle your personal information in accordance with its Privacy Policy and applicable laws.
11. Privacy Policy
• USEYA is committed to protecting your privacy. Please review our Privacy Policy for details on how your data is collected, used, and protected.
12. Governing Law and Jurisdiction
• These Terms are governed by the laws of Japan. Any disputes will be subject to the exclusive jurisdiction of the Osaka District Court.
13. Changes to Terms
• USEYA may modify these Terms at any time without prior notice. Changes are effective upon posting. Continued use constitutes acceptance of the new terms.
14. Disclaimer
• USEYA strives for accuracy but does not guarantee completeness or accuracy of information. USEYA is not responsible for damages resulting from errors or omissions. All information is provided "as is" without warranty of any kind.
15. Language
• These Terms are provided in English. In case of discrepancy with any translation, the English version prevails.
